nx8up is a marketplace. Sponsors fund campaigns, studios fund playtesting engagements, and creators apply, do the work, and get paid. These terms are the agreement that makes that possible: what you may do here, what we will do, and what happens when something goes wrong.
Agreeing to these terms
You accept these terms when you create an nx8up account and confirm them during onboarding, and again each time you use the platform. If you are using nx8up on behalf of a company — most sponsors and studios are — you confirm you may bind that company, and “you” means both you and it. If you do not accept these terms, do not use the platform.
Your account
You must be at least 18 years old to use nx8up. You agree to give accurate information, keep it current, and keep your credentials secure. Everything done under your account is treated as done by you, so tell us promptly if you believe someone else has access to it. One person or company, one account: do not create a second account to evade a suspension, a rating, or a tier.
The four roles
What you may do here depends on the role your account holds. A role is granted at onboarding and can only be changed by us.
- Creator
- Applies to campaigns and engagements, delivers deal submissions and proof of work, and receives payouts. A creator inside an engagement is a participant.
- Sponsor
- Creates and funds campaigns, reviews applications, accepts creators, and approves or rejects the proof of work they submit.
- Studio
- Creates and funds PC playtesting engagements, sets the tester requirements that gate them, and reviews participant feedback.
- Administrator
- nx8up staff. Administrators adjudicate disputes and refunds, act on reports, and can suspend accounts or reverse platform actions.
How the work runs
Campaigns and engagements are funded up front: a sponsor or studio pays the full budget before the work goes live, and those funds are held for the creators who complete it. A creator applies; the funder accepts or declines; accepted creators do the work and submit proof of it; the funder reviews and returns a verdict.
Accepting an application creates a real commitment on both sides. A funder who accepts a creator is expected to review their submission in good faith, within the window stated on the campaign or engagement. A creator who is accepted is expected to deliver what was asked for, on time, and to submit honest proof of it. Repeatedly failing either obligation affects your reputation on the platform and may cost you access to it.
What you may not do
Using nx8up in any of the following ways is a breach of these terms:
- Faking, buying, or inflating audience, playtime, achievements, or any other metric the platform measures or you report.
- Submitting proof of work you did not produce, or that does not correspond to the work that was accepted.
- Taking a relationship that began through a campaign or engagement here off-platform in order to avoid fees.
- Posting content that is unlawful, that infringes someone else's rights, or that you do not have permission to use.
- Ignoring the advertising, disclosure, and sponsorship-labelling rules that apply where you and your audience are.
- Harassing, threatening, or abusing another user, or misrepresenting who you are.
- Scraping, probing, overloading, or otherwise interfering with the platform or the accounts on it.
Where we see a breach, we may remove content, withhold or reverse a payout, adjust reputation, refund a funder, or suspend the account — proportionate to what happened.
Fees
nx8up retains a platform fee of 15% of each funded budget. The remainder is the payout pool, divided among the creators or participants who complete the work. The fee is shown before you commit funds and itemized on your invoice.
The rate that applies to a campaign or engagement is the one displayed when you funded it; a later change to our fees does not reach work already funded. Payments are processed by Stripe, and your use of them is also subject to Stripe's terms. Taxes charged on top of a budget are your responsibility.
Getting paid
Payouts reach creators through Stripe once the work is accepted, and require a connected Stripe account in good standing. We cannot pay you before that account can receive money, and a payout that fails at Stripe stays pending until the underlying problem is fixed.
You are responsible for your own taxes on what you earn here, and for any registrations or filings your country requires. nx8up is not your employer; nothing in these terms creates employment, partnership, or agency between us.
Refunds and disputes
A funder may request a refund where work was not delivered, or was delivered materially differently from what was accepted. A creator may dispute a rejection they believe was made in bad faith. Both go to an administrator, who decides on the record in the campaign or engagement — the brief, the submission, and the messages between you. That decision is final on the platform. Funds already paid out for accepted work are not clawed back except where fraud is established.
Your content
You keep ownership of everything you upload or submit — your profile, your deal submissions, your proof of work, and your feedback. We do not claim it.
To run the service you grant nx8up a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display that content where the product needs it: showing your profile to funders, showing a submission to the sponsor or studio reviewing it, and keeping records of completed work. The licence lasts as long as we hold the content and no longer. What a sponsor or studio may do with the content you deliver to them is set separately, by the brief you accepted, not by this page.
Reputation, levels, and tiers
Reputation, levels, and tester tiers are signals nx8up computes from what happens on the platform. They belong to the platform, not to you: we may change how they are calculated, recalculate them, or correct them where they were earned dishonestly. They are not a promise of future work, income, or placement, and no part of them can be transferred or sold.
Connected services
nx8up depends on services we do not run — Clerk for sign-in, Stripe for money, and Steam, YouTube, and Twitch for the platform statistics that gate and measure work. Connecting one means agreeing to its terms as well as these, and it means we read only the data that connection grants us. When one of them is unavailable or changes what it exposes, some signals may degrade; we will not invent a value to fill the gap, and a requirement that cannot be evaluated fails closed rather than passing.
Suspension and ending your account
You may stop using nx8up and ask us to close your account at any time; work already funded or accepted has to be settled first. We may suspend or close an account that breaches these terms, that we are required to act against, or that puts other users or the platform at risk. Where the reason allows it, we will say what happened and give you a chance to respond. Obligations that outlive the account — money owed, licences already granted, and the limits below — survive it.
What we do not promise
nx8up is provided “as is” and “as available”, to the maximum extent the law allows. We do not promise that the platform will be uninterrupted or error-free, that a campaign or engagement will attract applicants, that a creator will be accepted, or that any particular result will follow from work done here. We are a marketplace: we do not control what other users do, and we do not guarantee their conduct, their content, or the quality of their work.
Limits on liability
To the extent the law permits, nx8up is not liable for indirect, incidental, or consequential loss — including lost profit, lost audience, or lost opportunity — arising from your use of the platform. Where we are liable, our total liability is limited to the fees you paid us in the twelve months before the claim. Nothing here excludes liability that cannot lawfully be excluded.
Changes to these terms
We may update these terms as the product changes. Where a change is material we will give notice through the platform before it takes effect, and continuing to use nx8up after that constitutes acceptance where the law allows. The version in force is the one on this page, dated above.
Governing law
These terms, and any dispute arising from them, are governed by the law of the jurisdiction in which nx8up operates, whose courts have exclusive jurisdiction over them. This section is a placeholder: the operating entity and its jurisdiction will be named here before these terms are relied on.
